PARTICIPATION CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES. PLEASE READ CAREFULLY.
The ESA Foundation Lumberyard Hackathon Sponsored by Amazon Games (“Hackathon”) is intended for individuals currently enrolled in and attending an accredited high school or undergraduate degree program, age sixteen (16) years or older, who are legal residents of one of the 50 United States or the District of Columbia. Do not proceed if you are not a legal resident of the United States [or the District of Columbia] currently located and residing therein or are less than sixteen (16) years of age. As used herein, the term “you” refers to you, the entrant, both as an individual and/or as part of a team. Further eligibility restrictions are contained in these Official Rules below.
DESCRIPTION: The Hackathon takes place on Saturday, October 19, 2019. By participating in the Hackathon, you unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of the ESA Foundation (the “Sponsor”), whose decisions shall be final and legally binding in all respects. In order to participate in the Hackathon, you must accept and adhere to these Official Rules. Therefore, please read these Official Rules prior to participating to ensure you understand and agree. You agree that participating in the Hackathon constitutes your agreement to these Official Rules. You may not participate in the Hackathon, including submitting an Application Form, and are not eligible to receive any prize described in these Official Rules unless you formally agree to these Official Rules. These Official Rules form a binding legal agreement between you and Sponsor with respect to the Hackathon.
ELIGIBILITY: To be eligible to enter and participate in the Hackathon, you must:
- be a citizen or legal permanent resident of the United States;
- be willing and able to travel to Washington, DC at your own expense to participate in the Hackathon on-site;
- be currently enrolled in and attending an accredited high school or undergraduate degree program;
- on October 19, 2019, arrive at the co-working space powered by Verizon, the Alley, located at 2055 L Street NW, Washington, DC 20036 (“Hackathon Location”), no later than 8:45 AM ET, and remain on-site until 8:00 PM ET or the end of the Hackathon event, whichever is earlier;
- complete and submit during the Application Period (as defined in these Official Rules below) the application form for the Hackathon as provided by Sponsor (or if you are below the age of majority in your state of legal residence, your parent or legal guardian must complete and submit the application form for the Hackathon as provided by Sponsor, which requires signature by your parent or legal guardian to provide consent for your participation in the Hackathon);
- accept and adhere to these Official Rules (or if you are below the age of majority in your state of legal residence, your parent or legal guardian must accept and adhere to these Official Rules on his/her and your behalf);
- sign and submit to Sponsor the Prize Documents as defined in these Official Rules below (or if you are below the age of majority in your state of residence, your parent or legal guardian must sign and submit the Prize Documents as defined in these Official Rules below on your behalf); and
- Entries must be completed and submitted no later than October 19, 2019 at 6:00 PM ET.
Employees, officers, and directors of Sponsor, Amazon Games, or Verizon (collectively, the “Hackathon Entities”), or any of their respective parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household (whether related or not) are not eligible to enter or win. If you are an employee of a corporation, government agency, or an academic institution, you are responsible for ensuring that your participation in the Hackathon complies with any policies your corporation, government agency, or academic institution may have regarding participation in contests of this type. If Sponsor believes at any time that you violate any of those policies, Sponsor, in its sole discretion, reserves the right to reject your entry to the Hackathon, prohibit you from participating in the Hackathon or revoke any prize that you may have received in the Hackathon. Sponsor is not responsible for any disputes arising between you and your employer.
Sponsor reserves the right, in its sole discretion, to assess your eligibility and compliance with these Official Rules at any point during the Hackathon. If Sponsor requires any assistance in order to assess your compliance, you must promptly provide that assistance. If you do not provide the requested assistance or if Sponsor has reason to believe that you are not complying with these Official Rules, you may be disqualified, in Sponsor’s sole discretion.
HOW TO ENTER: The application period for participating in the Hackathon will open on October 4, 2019 at 10:00 AM ET and close on October 18, 2019 at 11:30 PM ET (the "Application Period"). During the Application Period, visit https://esa-foundation-lumberyard-hack.devpost.com/ (the “Hackathon Website”) and complete and submit the application form (the “Application”) available on the Hackathon Website. If you are below the age of majority in your state of residence, your parent or legal guardian must complete the Application on your behalf. You must complete all required fields of the Application and all information provided in your Application must be accurate and truthful. Sponsor is not responsible for any inaccurate or false information you provide and may, in its sole discretion, disqualify any participant who provides false information in his/her Application. On-site registration is discouraged and Sponsor may in its sole discretion turn away any attendees who did not properly complete and submit the Application during the Application Period. By submitting the Application, you agree to abide by and accept the terms of these Official Rules.
After submitting the Application, attend and participate in the Hackathon, and at the end of the Hackathon submit your team’s Lumberyard game demo (each team’s Lumberyard game demo, an “Entry”). Participants will be randomly assigned to teams of up to four (4) members on-site at the Hackathon. Participants may not join or participate in more than one (1) team. Sponsor reserves the right to modify the makeup of any team and/or to form new teams in its sole discretion. All of Sponsor’s decisions regarding team makeup are final and in Sponsor’s sole discretion.
DAY OF HACKATHON PROCEDURE: The Hackathon will take place on Saturday, October 19, 2019 at the Hackathon Location. The following is the schedule for October 19, 2019:
- 8:00 AM ET – 9:00 AM ET: Participant arrival; participant check-in; breakfast
- 9:00 AM ET – 12:00 PM ET: Introduction; team assignment; workshop on how to use Scriptcanvas and Lumberyard
- 12:00 PM ET – 6:00 PM ET: Hackathon competition period (“Hackathon Period”). Lunch and snacks will be made available to participants during the Hackathon Period.
- 6:00 PM ET – 8:00 PM ET: Dinner; Entry presentations by teams; judging; award ceremony
On October 19, 2019, participants are required to arrive at the Hackathon Location no later than 8:45 AM ET and remain at the Hackathon Location until 8:00 PM ET or the end of the Hackathon event (whichever is earlier). Off-site participation is not permitted.
NOTE THAT SPACE IS LIMITED AT THE HACKATHON SITE, AND THERE ARE ONLY ONE HUNDRED (100) SPACES AVAILABLE. Spaces will be allocated on a first-come, first-serve basis.
At the close of the Hackathon Period, Entries must be submitted to Sponsor for judging pursuant to the technologically-reasonable procedures made available by Sponsor for the respective Entries. Sponsor is not responsible for late, erroneous, misdirected, or incomplete Entries, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Mere proof of transmission does not constitute proof of Sponsor’s receipt of entry. Entries will be considered void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically-reproduced or obtained through fraud or theft, or if they do not meet the requirements described in these Official Rules. Entries not submitted by the close of the Hackathon Period will not be eligible to win any prizes. LIMIT: ONE (1) ENTRY PER TEAM.
HACKATHON LOCATION: The Hackathon Location is at the co-working space powered by Verizon, the Alley, located at 2055 L Street NW, Washington, DC 20036.
USE OF TECHNOLOGY: You may use your own laptop computer to participate in the Hackathon. If you do not have a laptop computer, Sponsor in its sole discretion may, for the duration of the Hackathon Period, lend you technology to facilitate your participation in the Hackathon. YOU ARE SOLELY RESPONSIBLE FOR INDICATING ON YOUR APPLICATION FORM WHETHER YOU NEED TO BORROW TECHNOLOGY FROM SPONSOR. YOU MUST REQUEST A TECHNOLOGY LOAN IN ADVANCE.
SUBMISSION REQUIREMENTS: Neither the Application nor the Entries (or any other submissions related thereto) may contain, as determined by Sponsor in its sole discretion, any content that: (i) is sexually explicit or suggestive; (ii) is violent or derogatory of any ethnic, racial, gender, religious, professional or age group; (iii) is profane, pornographic, or otherwise contains nudity; (iv) promotes alcohol, illegal drugs, tobacco, working firearms, or other weapons, or the use of any of the foregoing; (v) promotes any activity that may appear unsafe or dangerous; (vi) promotes any political or religious agenda or message; (vii) is obscene or offensive, or endorses any form of hate or hate group; (viii) defames, misrepresents, or disparages people or entities; (ix) violates or infringes upon the rights of any third party, including patents, copyrights, trademarks, trade secrets, or rights of privacy or publicity; (x) communicates messages or images inconsistent with the positive images and/or good will with which Sponsor wishes to associate; and/or (xi) otherwise violates these Official Rules or any law, rule, or regulation.
Each participant is solely responsible for the accuracy and completeness of his/her team’s Entry, as well as for clearing the third-party rights for any and all third-party content contained in his/her team’s Entry. Further, to enhance the results of this Hackathon, each Entry should be the original work of the participant(s) and owned solely by those participant(s) who created that particular Entry. To the extent it is not, each Entry must be supported by and may be subject to verification that the participant(s) has secured all rights necessary (such as those from third parties) in order to permit submission to and use by Sponsor in connection with the Hackathon and these Official Rules. Accordingly, each Entry must be new and innovative, must not misappropriate, violate, or infringe upon the copyrights, trademarks, rights of privacy, publicity, or other intellectual property or other rights of any person or entity, and must be freely available for use in connection with the Hackathon and as contemplated by these Official Rules. Sponsor reserves the right to request proof or verification of adherence to these requirements. If Sponsor makes such a request, failure by any participant to provide such proof may render that Entry null and void, and all team participants may be disqualified as determined by Sponsor in its sole discretion. By submitting an Entry, you warrant and represent that you and any persons appearing or who are identifiable in the Entry consent to the submission, use, and right(s) to use of the Entry in the Hackathon and to its use as otherwise set forth herein.
JUDGING CRITERIA: All eligible Entries received throughout or at the conclusion of the Hackathon Period will be judged by a panel of qualified judges based on the following criteria (collectively, the “Judging Criteria”):
- Drawing In Players: How well does the game attract players to want to try it?
- Accessibility: Is the game intuitive and easy to learn?
- “Wow” Factor: How well does the game hold the player’s attention span?
- Completion and Scope: Is the game completed during the Hackathon Period and able to be demonstrated?
- Use of Motion: How well does the game use motion/math functions?
- Functionality: How well do all elements of the game work together?
- “Bowl of Spaghetti”: How well does the game function in the absence of structured source code?
The weight assigned to each of the Judging Criteria depends on the prize, as illustrated in the table below. Read the Prizes section of these Official Rules for more details on the prizes.

PRIZES: After all eligible Entries received are judged based on the above criteria, the following prizes will be awarded:
- Grand Prize (One (1) Team): The team that receives the highest score according to the Judging Criteria, weighted according to the table above, will be deemed the Grand Prize winning team. Subject to verification of eligibility and compliance with these Official Rules, each member of that team containing up to four (4) participants will receive one (1) gift card worth USD$250.00, for a maximum of up to four (4) individual Grand Prize recipients. Maximum approximate retail value (“ARV”): USD$1,000.00.
- Honorable Mention (Up to Three (3) Teams): A maximum of three (3) teams that receive the second and third (and at Sponsor’s sole discretion, the fourth) highest scores according to the Judging Criteria, weighted according to the table above, will be deemed the Honorable Mention teams. Each member of these teams, each containing up to four (4) participants, will receive one (1) gift card worth USD$150.00, for a maximum of up to twelve (12) individual Honorable Mention recipients. Maximum ARV: USD$1,800.00.
- Concept Prizes
- Best Use of Motion Concept Prize (One (1) Team): The one (1) team that receives the highest score according to the Use of Motion Judging Criterion (see table above) will be deemed the Best Use of Motion Concept Prize winning team. Each member of this team, containing up to four (4) participants, will receive one (1) gift card worth USD$100.00, for a maximum of up to four (4) individual Best Use of Motion Concept Prize recipients. Maximum ARV: USD$400.00.
- Most Functional Game Concept Prize (One (1) Team): The one (1) team that receives the highest score according to the Functionality Judging Criterion (see table above) will be deemed the Most Functional Game Concept Prize winning team. Each member of this team, containing up to four (4) participants, will receive one (1) gift card worth USD$100.00, for a maximum of up to four (4) individual Most Functional Game Concept Prize recipients. Maximum ARV: USD$400.00.
- “Bowl of Spaghetti” Concept Prize (One (1) Team): The one (1) team that receives the highest score according to the “Bowl of Spaghetti” Judging Criterion (see table above) will be deemed the “Bowl of Spaghetti” Concept Prize winning team. Each member of this team, containing up to four (4) participants, will receive one (1) gift card worth USD$100.00, for a maximum of up to four (4) individual “Bowl of Spaghetti” Concept Prize recipients. Maximum ARV: USD$400.00.
- Total Maximum ARV of all prizes: USD$4,000.00.
PRIZE LIMITS: There are two types of prizes: (1) overall prizes, which include the Grand Prize and the Honorable Mention prizes; and (2) concept prizes (“Concept Prizes”), which include the Best Use of Motion Concept Prize, the Most Functional Game Concept Prize, and the “Bowl of Spaghetti” Concept Prize. A single team may win both types of prizes, but no team can win more than one prize within a single prize type. In other words, a team can win (1) either a Grand Prize or an Honorable Mention Prize; and (2) a maximum of one Concept Prize. If a team achieves the highest score on more than one of the Concept Prize Judging Criteria, the team will be awarded only one of the Concept Prizes, and the remaining Concept Prizes will be awarded to the next highest scoring team according to that Judging Criterion.
PRIZE WINNER NOTIFICATION: Prize-winning participants (collectively, the “Prize Winners”) will be notified of their win at the Hackathon Location after judging is complete.
PRIZES WILL BE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED BY SPONSOR. Additional terms and conditions apply to gift card prizes; see front and back of gift card for additional terms and conditions. All prize details are at the sole discretion of the Sponsor. All provincial, state, and local taxes and withholdings and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the Prize Winners. Prize Winners cannot assign or transfer a prize to another person. Lost or stolen prizes will not be replaced. If a prize cannot be awarded, a substitute prize of comparable or greater retail value may be awarded. The value of the prize represents Sponsor’s good-faith determination of the maximum retail value thereof. No refunds or credit for changes are allowed. Other restrictions may apply, including, but not limited to, the terms and conditions of gift card use. If a prize goes unclaimed or a potential Prize Winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential Prize Winner will be disqualified and a runner-up for the applicable prize will be selected according to the procedures described above.
WINNER VERIFICATION: In order to win a prize, the potential prize winners must comply with all terms and conditions of these Official Rules. Each member of the winning teams will be required to sign (or if you are below the age of majority in your state of residence, your parent or legal guardian will be required to sign on your behalf) a[n] Affidavit/Declaration of Eligibility, Liability and Publicity Release (“Prize Documents”), which will include, without limitation, (i) a release of the Released Parties similar to what is set forth in the “Conditions of Participation and Releases” section below; and (ii) a grant to the Sponsor and its agencies of the unrestricted rights, in their collective or individual discretion, to publish and use your name, hometown, likeness, voice, broadcast footage, Entry, statements, biographical data, or prize information in perpetuity for advertising and publicity purposes worldwide without limitation and without additional compensation, except where prohibited. If a potential prize winner cannot be contacted, or fails to sign and return the Prize Documents on site at the Hackathon (but no later than thirty (30) days after the Hackathon) or is found to be ineligible, that potential prize winner will be deemed disqualified and will forfeit the prize. In addition to the Prize Documents, potential prize winners may be required to complete a W‐9 tax form in order to receive a prize. If you do not sign the required forms or provide the required information in a timely manner, we may disqualify your entire team from receiving a prize. All federal, state, local, and other taxes and duties that may become due as a result of winning a prize are the sole responsibility of the prize winner.
In the event that an individual potential prize winner, or that individual’s team’s Entry, is disqualified for any reason, Sponsor may award a prize to the team with the next highest score based on the judges’ scoring. The Sponsor will repeat this process until a winning team is determined and all prizes have been awarded.
POTENTIAL PRIZE WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE HACKATHON. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
PERSONAL INFORMATION AND PRIVACY: Any personal information sent to, shared with, or collected by Sponsor in connection with the Hackathon is subject to Sponsor’s Privacy Policy, found http://www.esafoundation.org/privacy-policy.asp. Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives or service providers may use entrants’ and/or referrals’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or event that Sponsor thinks may be of interest.
CONDITIONS OF PARTICIPATION; RELEASES; PUBLICITY: All federal, state, territorial, and local laws and regulations apply. By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final in all respects. By participating in this Hackathon and, as the case may be, by accepting any prize, you agree to release the Hackathon Entities and each of their respective parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and website providers, and their respective successors, employees, agents, representatives, and assigns (collectively, the "Released Parties") from any and all actions, claims, injuries, death, losses, or damages arising in any manner, directly or indirectly, from participation in this Hackathon and/or acceptance or use of a prize (including any activity related thereto). The Released Parties shall not be liable for: (i) any injuries, losses, liabilities, or damages of any kind including personal injury or death caused by the prize or resulting from acceptance, possession, or use of a prize or from participation in the Hackathon; (ii) telephone system, telephone, or computer hardware, software, or other technical or computer malfunctions, lost connections, disconnections, delays, or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to, or alteration of Entry or other materials; (iv) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled, or unintelligible Entries, communications, or affidavits, regardless of the method of transmission; (v) any inability of Prize Winner to accept or use any prize (or portion thereof) for any reason and such prize or portion thereof shall be forfeited; or (vi) any printing, typographical, human administrative, or technological errors in any materials or activities associated with the Hackathon. Prize Winners may be asked to participate in select publicity activities, as determined at the sole discretion of the Hackathon Entities. Hackathon Entities are not obligated to use any of the above-mentioned information or publicity materials, but may do so and may edit such information or materials, at Hackathon Entities’ sole discretion, without further obligation or compensation. Hackathon Entities disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with, this Hackathon or use of a prize. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Hackathon (or any portion of the Hackathon) at any time for any reason or should a virus, bug, computer problem, unauthorized intervention, extenuating circumstance, or other problem or cause corrupt or inhibit the administration, security, or proper play of the Hackathon and, in such situation, may select the potential Hackathon Prize Winners using the Judging Criteria identified above. Sponsor may prohibit you from participating in the Hackathon or winning a prize if, in its sole discretion, it determines you are attempting to undermine the legitimate operation of the Hackathon by cheating, hacking, deception, or any other unfair practices or intending to annoy, abuse, threaten, or harass any other Hackathon participant or Hackathon Entities representatives. WARNING: ANY ATTEMPT BY AN ENTRANT, PARTICIPANT, OR ANY OTHER INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEBSITE AND/OR TECHNOLOGY ASSOCIATED WITH THIS HACKATHON OR UNDERMINE THE LEGITIMATE OPERATION OF THE HACKATHON MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR MAY, IN ITS SOLE DISCRETION, DISQUALIFY SUCH ENTRANT(S), PARTICIPANT(S) OR OTHER INDIVIDUAL(S) AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL(S) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
INDEMNITY: Participants hereby agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury, or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (i) any participant’s participation in the Hackathon; (ii) a breach or allegation which if true would constitute a breach, of any participant’s representations, warranties, or obligations herein; and (ii) acceptance, possession, grant, or use of any prize, including without limitation, personal injury, death, and property damage arising therefrom.
INTELLECTUAL PROPERTY RIGHTS AND LICENSE: As between you and Sponsor and until otherwise agreed, you will retain ownership of your Entry, aside from those rights that may be granted under Lumberyard’s Terms of Service or other applicable agreements. As a condition of entry, however, you hereby grant Sponsor, its subsidiaries, affiliates, agents, and partner companies, including, but not limited to, the Hackathon Entities, a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display your Entry: (i) for the purposes of allowing Sponsor and the judges to use and evaluate the Entry for purposes of the Hackathon; (ii) for advertising and promotional purposes via communication to the public or other groups, including, but not limited to, the right to make screenshots, animations and Entry clips available for advertising and promotional purposes; and (iii) in connection with evaluating, using, or exploiting any associated idea(s) or concept(s) developed separately by Sponsor (or its agent(s) or affiliate(s) for any purpose). You agree to execute all documentation that may be required for use of the Entry in connection with the rights granted herein. In addition, you acknowledge and agree that Sponsor (or its designated affiliate) will have the option and right of first refusal to enter into an additional and mutually agreed upon license or other agreement granting or conveying to Sponsor additional or all rights to the Entry. Nothing contained in this provision, however, constitutes a grant by Sponsor to you of any right of any nature.
FORUM AND RECOURSE TO JUDICIAL PROCEDURES: These Official Rules are governed by, subject to, and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. If any provision of these Official Rules is held to be invalid or unenforceable, that part may be changed and interpreted so as to best accomplish the objectives of the original part to the fullest extent allowed by law, all remaining provisions hereof will remain in full force and effect.
MISCELLANEOUS TERMS: Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. These Official Rules represent the entire agreement between you and Sponsor with respect to the Hackathon, and supersede all prior or contemporaneous communications in any form between you and Sponsor with respect to the Hackathon. No joint venture, partnership, employment, alliance, or agency relationship exists between you and Sponsor as a result of these Official Rules or the Hackathon. These Official Rules may not be assigned or transferred by you without the prior express written consent of Sponsor.
